These terms apply when you use Withy, operated by Matthew Tymus, trading as Withy (“we”, “us”). By creating an account or using the service, you agree to these terms.

What Withy is

Withy is a planning and discovery tool that suggests which Sustainable Farming Incentive actions might suit your farm, based on land data and information you provide. It is not a compliance-checked application service. See our disclaimer for the full position.

Your account

You must provide accurate information when creating an account and about your farm. You are responsible for keeping your login details secure and for all activity under your account.

Fees and billing

Withy is billed as an annual subscription per account: £25 for your first farm, £10 per year for each additional farm. Your subscription renews automatically each year unless cancelled. We’ll email you a reminder around 14 days before renewal.

Cancellation and refunds

You can cancel at any time from your account settings — you never need to email us to cancel. We offer a 30-day money-back guarantee, refunded on request with no questions asked, on your initial purchase and on every renewal.

You also have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By accepting these terms and requesting that your plan be generated immediately, you agree that your service begins within the cancellation period, but this does not reduce the refund guarantee above, which is more generous than the statutory minimum.

No guarantee of eligibility or payment

Any action, eligibility, or payment figure shown by Withy is an estimate based on published SFI rates and the information you’ve provided. We do not warrant that any action is available on your land, that an application based on your plan will be approved by the RPA, or that any estimated figure will match the amount you actually receive.

Limitation of liability

To the extent permitted by law, we are not liable for any loss arising from decisions you make based on a Withy plan, including a rejected application, a lower payment than estimated, or a missed deadline. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud.

Data

We handle your farm and account data as described in our privacy policy.

Changes to these terms

We may update these terms from time to time. We’ll tell you about material changes before they take effect.

Governing law

These terms are governed by the law of England and Wales.
